Are Your Properties in East Ham Legally Compliant with the 2026 Fire Safety Laws?

If you own, manage, lease, or operate commercial premises, an HMO, or a multi-occupied residential building in England and Wales, compliance is a strict statutory duty. Under current statutory standards, failing to maintain a valid, written Fire Risk Assessment (FRA) in East Ham leaves your organisation exposed to immediate enforcement notices, voided property insurance, and unlimited financial penalties.

Defensible Legal Protection:

Our Level 4 accredited Fire Risk Assessors in East Ham deliver exhaustive, audit-ready reports. These documents are designed to withstand the scrutiny of Fire & Rescue Services and local authorities. They also meet the requirements for mortgage providers, insurance underwriters, and mortgage lenders.

Fire legislation changes rapidly. We support you long after delivering your reports, giving you continuous access to specialist advice to systematically lower your property portfolio’s risk profile.

Statutory Realities: How the Law Impacts You

The primary fire safety law in England and Wales centres on the Regulatory Reform (Fire Safety) Order 2005 (FSO), making compliance a strict statutory duty. This framework is reinforced by three major pieces of legislation which impose stringent management, recording, and reporting duties on the designated Responsible Person (RP):

Fire Safety Act 2021:

Mandates that the FRA  in East Ham must explicitly evaluate the building’s structural framework, external wall systems (cladding, balconies, windows), and flat entrance doors opening into communal areas.

Fire Safety (England) Regulations 2022:

Requires precise asset tracking, routine inspections of fire doors and lifts in East Ham, and digital sharing of floor plans and wall designs with local Fire and Rescue Services.

Building Safety Act 2022 (Section 156):

Overhauls accountability. It makes recording the complete FRA and the identity/competence of the assessor a legal requirement, while mandating that findings be shared directly with residents.

Enforcement & Liability:

Minor penalties have been replaced by strict liability frameworks. If you ignore highlighted items or have gaps in compliance, you may receive immediate enforcement notices. You could also be subject to unlimited corporate fines and direct corporate liability imprisonment.

THE FIRE RISK ASSESSMENT East Ham, E6

The guidance documents that support fire law recommend a five-stage approach to fire risk assessment in East Ham, E6.

Step 1 - Hazards

Identify the hazards within your premises including sources of ignition, sources of fuel and any oxidising agents other than air.

Step 2 - Who is at risk?

Identify people at risk. You must consider everyone who might be at risk from a fire on your premises, whether they are employees, tenants, occupants, visitors or members of the public. You should pay particular attention to people who may be at particular risk such as:
people working near to fire hazards, lone workers, children, parents with babies, the elderly, the infirm and people with disabilities, or anyone who may need special help.

Step 3 – Evaluate the level of risk

You should remove or reduce fire hazards where possible. The residual risk should be
minimised.

You need to look at:

• Means of detecting fire and giving warning
• Firefighting and summoning the fire and rescue service
• Escape routes including fire exits, emergency lighting and escape route signs
• Evacuation of vulnerable people or those with special needs
• Training for your staff
• Information on fire safety for anyone who may need it (e.g. staff and visitors)
• A management system to make sure that your fire precautions, including your risk
assessment, remain effective

Step 4 – Record, plan, instruct, inform and train You should:

• Record the findings from the fire risk assessment, as well as the fire safety measures you have taken and are going to take
• If you haven’t already got one, make an emergency plan, tailored to your premises
• Give staff, occupants, visitors or guests details of your fire action plan
• Provide employees with training about the risks and actions they should take to prevent Fire and how to respond if a fire occurs. This includes full time, part-time, temporary and unpaid employees. Some people such as fire marshals will need a more detailed training

Step 5 – Review your fire-risk assessment to ensure it is up to date

You will need to re-examine your fire-risk assessment annually or if you suspect it is no longer valid, such as after a near miss, or if there is a significant change such as a change of processes, occupants, or the layout of the building.

WHO IS RESPONSIBLE?

‘The Responsible Person’ for fire safety is anyone (or company) who to any significant degree has:

• Control of the premises, e.g. the owner, landlord, freeholder or the managing agent
• Control over the activities on the premises (occupier)
• Employs people within the premises
They are responsible for the safety of people who may:
• Legitimately, be on or living within the premises, or
• Not on the premises but might be directly affected by a fire on the premises

In many cases, responsibility may be shared between several people but it is not the responsibility of the fire service or any other statutory body.

The ‘Responsible Person’ (or persons if there are more than one), must make sure that everyone is safe from fire.
